본 약관은 주식회사 스팀엔진(이하 "회사")가 제공하는 캠코더 앱
「Ditto」(이하 "앱")의 이용과 관련하여 회사와 이용자 간의 권리, 의무
및 책임사항을 정함을 목적으로 합니다.
제2조 (약관의 효력 및 변경)
본 약관은 앱을 설치하거나 실행하는 모든 이용자에게 적용되며,
이용자가 앱을 이용함으로써 본 약관에 동의한 것으로 봅니다.
회사는 관련 법령을 위반하지 않는 범위에서 본 약관을 개정할 수
있습니다. 개정 시에는 시행일과 개정 사유를 명시하여 시행일 7일
전부터 본 페이지에 게시하며, 이용자에게 불리한 변경은 시행일 30일
전부터 게시합니다.
개정 약관 시행 후에도 앱을 계속 이용하는 경우 개정 약관에 동의한
것으로 봅니다. 동의하지 않는 이용자는 앱 이용을 중단하고 앱을
삭제할 수 있습니다.
제3조 (서비스의 내용)
앱은 스마트폰 카메라로 옛 캠코더 느낌의 영상을 촬영하고, 촬영한
영상을 가상의 테이프에 모아 재생·편집·저장하는 앱입니다.
앱은 회원가입 없이 이용할 수 있습니다. 내 테이프(공유하지 않는
테이프)는 무료이며, 촬영한 영상은 이용자의 기기에만 저장됩니다.
공유 테이프는 여러 사람이 한 테이프에 함께 촬영하는 유료
기능으로, 제4조와 제5조에 따릅니다.
앱은 Apple App Store를 통해 제공됩니다.
제4조 (공유 테이프)
공유 테이프는 정해진 길이(10분, 30분, 60분)의 테이프로, 테이프를
구매한 이용자(이하 "호스트")가 초대 링크로 다른 이용자(이하
"참여자")를 초대합니다. 초대 링크를 가진 사람은 누구나 테이프에
참여할 수 있으므로, 링크는 함께 촬영할 사람에게만 전달해야 합니다.
테이프의 길이는 참여자 전원이 함께 쓰는 녹화 시간입니다. 촬영한
영상은 회사 서버에 업로드되어 같은 테이프의 참여자 모두가
재생·저장할 수 있습니다. 남은 시간보다 긴 영상은 테이프 끝에서
잘리며, 테이프가 가득 차면 더 이상 촬영할 수 없습니다.
영상은 촬영 시각 순서로 테이프에 놓입니다. 영상을 촬영한 참여자와
호스트는 그 영상을 잘라내거나 삭제할 수 있고, 삭제하면 그만큼의
테이프 시간이 다시 생깁니다.
호스트는 언제든지 테이프 전체를 삭제할 수 있으며, 이 경우 서버에
저장된 모든 영상이 참여자 전원에게서 삭제됩니다. 참여자는 언제든지
테이프에서 나갈 수 있습니다. 어느 경우에도 이용자 본인이 촬영한
영상은 본인 기기에 내 테이프로 남습니다.
공유 테이프는 참여자가 이용하는 동안 서버에 보관됩니다. 회사가
보관 기간을 정하거나 자동 삭제를 도입하는 경우 앱과 본 약관을
통해 시행일 30일 전에 고지합니다.
제5조 (인앱 결제 및 환불)
공유 테이프의 구매는 Apple App Store의 인앱 결제로 처리됩니다.
결제 조건, 결제 취소와 환불은 App Store의 정책과 절차를 따릅니다.
구매한 테이프는 결제 완료 즉시 만들어져 바로 촬영과 초대에 사용할
수 있습니다. 이미 촬영이 시작된 테이프는 「전자상거래 등에서의
소비자보호에 관한 법률」 제17조 제2항에 따라 청약철회가 제한될 수
있습니다.
결제는 되었으나 테이프가 만들어지지 않은 경우 제9조의 문의처로
결제 영수증과 함께 연락해 주시기 바랍니다. 회사는 확인 후 테이프를
만들거나 환불을 처리합니다.
미성년자가 법정대리인의 동의 없이 결제한 경우 미성년자 본인 또는
법정대리인은 관련 법령에 따라 결제를 취소할 수 있습니다. 취소
절차는 App Store의 정책을 따릅니다.
제6조 (이용자의 영상과 의무)
이용자가 촬영한 영상의 권리는 이용자에게 있습니다. 이용자는 공유
테이프에 영상을 올림으로써, 회사가 그 영상을 같은 테이프의
참여자에게 보여 주고 저장하게 하는 데 필요한 범위에서 영상을
저장·전송할 수 있도록 허락합니다. 회사는 영상을 다른 목적으로
사용하지 않습니다.
이용자는 다음 행위를 해서는 안 됩니다.
타인의 동의 없이 타인을 촬영하여 공유 테이프에 올리는 행위
타인의 저작권, 초상권, 사생활 등 권리를 침해하거나 법령에
위반되는 영상을 올리는 행위
앱이나 서버를 비정상적인 방법으로 이용하거나 방해하는 행위
회사는 법령이나 권리자의 정당한 요청이 있는 경우 해당 영상 또는
테이프를 삭제할 수 있으며, 위반이 반복되는 기기의 공유 기능 이용을
제한할 수 있습니다.
공유 테이프의 영상은 같은 테이프의 참여자 모두가 저장할 수
있습니다. 이용자는 이를 이해하고 영상을 올려야 하며, 다른 참여자가
저장한 영상의 이후 이용에 대해 회사는 관여할 수 없습니다.
제7조 (지식재산권)
앱과 그 화면, 그림, 소리, 프로그램에 대한 권리는 회사에 있습니다.
이용자는 앱을 개인적인 용도로 이용할 수 있으며, 회사의 허락 없이
앱을 복제, 변경, 배포하거나 역설계할 수 없습니다.
제8조 (서비스의 변경 및 중단)
회사는 앱의 기능을 추가하거나 변경할 수 있으며, 중요한 변경은
앱 스토어 페이지 또는 앱을 통해 알립니다.
회사는 운영상·기술상 필요에 따라 공유 테이프 서비스의 전부 또는
일부를 중단할 수 있습니다. 이 경우 중단일 30일 전에 앱과 본
페이지를 통해 고지하며, 이용자가 그 기간 동안 공유 테이프의 영상을
기기에 저장할 수 있도록 합니다. 내 테이프는 서버와 무관하게
기기에서 계속 이용할 수 있습니다.
제9조 (책임의 제한 및 문의처)
회사는 천재지변, 통신 장애, 앱 스토어와 서버 사업자 등 제3자
서비스의 장애, 이용자 기기의 문제 등 회사의 합리적인 통제를 벗어난
사유로 발생한 손해에 대해 책임을 지지 않습니다.
영상은 이용자의 기기와 앱 안에 저장됩니다. 기기 분실, 고장, 앱
삭제 등으로 영상이 사라지는 경우에 대비하여 중요한 영상은 사진
앱에 저장해 두시기 바랍니다. 회사는 이용자의 귀책사유로 발생한
손해에 대해 책임을 지지 않습니다.
회사의 고의 또는 중대한 과실로 이용자에게 손해가 발생한 경우
회사는 관련 법령에 따라 책임을 부담합니다.
These Terms set out the rights, obligations, and responsibilities
between Steam Engine Co., Ltd. (the "Company") and users of the
camcorder app Ditto (the "App").
2. Acceptance and Changes
These Terms apply to everyone who installs or runs the App. By
using the App you agree to these Terms.
The Company may revise these Terms within the limits of applicable
law. Revisions are posted on this page at least 7 days before they
take effect, with the effective date and the reason, and at least
30 days before when they are unfavourable to users.
Continuing to use the App after a revision takes effect means you
accept it. If you do not agree, stop using the App and delete it.
3. The Service
The App records video with the phone's camera in the style of an
old camcorder and collects the recordings on virtual tapes for
playback, editing, and saving.
The App needs no account. Local tapes (tapes you do not share) are
free, and their recordings are stored only on your device.
Shared tapes, a paid feature that lets several people record onto
one tape together, are governed by Sections 4 and 5.
The App is distributed through the Apple App Store.
4. Shared Tapes
A shared tape has a fixed length (10, 30, or 60 minutes). The user
who buys it (the "host") invites other users ("participants") with
an invite link. Anyone who has the link can join the tape, so give
it only to the people you want to record with.
The tape's length is recording time that all participants share.
Recordings are uploaded to the Company's server so that every
participant on the tape can play and save them. A recording longer
than the time left is cut at the end of the tape, and no more can
be recorded once the tape is full.
Recordings are placed on the tape in the order they were shot. The
participant who shot a recording and the host may trim or delete
it; deleting frees up the tape time it used.
The host may delete the whole tape at any time, which removes every
recording on the server for all participants. A participant may
leave a tape at any time. In either case, your own recordings stay
on your device as a local tape.
Shared tapes are kept on the server while participants use them. If
the Company introduces a retention period or automatic deletion, it
will give 30 days' notice in the App and in these Terms.
5. In-App Purchases and Refunds
Shared tapes are bought through Apple App Store in-app purchase.
Payment terms, cancellations, and refunds follow the App Store's
policies and procedures.
A purchased tape is created as soon as payment completes and can be
used for recording and invitations immediately. Under Article
17(2) of the Act on Consumer Protection in Electronic Commerce of
the Republic of Korea, the right of withdrawal may be limited once
recording on a tape has begun.
If you were charged but no tape was created, contact us at the
address in Section 9 with your purchase receipt. After
verification, the Company will create the tape or process a
refund.
If a minor makes a purchase without the consent of a legal
guardian, the minor or the guardian may cancel the purchase in
accordance with applicable law, following the App Store's
procedures.
6. Your Recordings and Obligations
You own the recordings you make. By uploading a recording to a
shared tape you allow the Company to store and transmit it to the
extent needed to show it to, and let it be saved by, the
participants on that tape. The Company does not use recordings for
any other purpose.
You must not:
record other people without their consent and upload the
recording to a shared tape;
upload recordings that infringe another person's copyright,
likeness, privacy, or other rights, or that violate the law;
use or interfere with the App or the server in an abnormal way.
The Company may remove a recording or a tape when required by law
or on a legitimate request from a rights holder, and may restrict
shared-tape use from a device that repeatedly violates these Terms.
Every participant on a shared tape can save its recordings. Upload
with this in mind; the Company has no control over what other
participants do with recordings they have saved.
7. Intellectual Property
The App and its screens, artwork, sounds, and software belong to the
Company. You may use the App for personal purposes; you may not copy,
modify, distribute, or reverse-engineer it without the Company's
permission.
8. Changes to and Discontinuation of the Service
The Company may add or change features of the App. Significant
changes are announced on the App Store page or in the App.
The Company may discontinue all or part of the shared-tape service
for operational or technical reasons. It will give 30 days' notice
in the App and on this page, during which you can save the
recordings on your shared tapes to your device. Local tapes keep
working on your device regardless of the server.
9. Limitation of Liability and Contact
The Company is not liable for damages caused by events beyond its
reasonable control, including natural disasters, network failures,
outages of third-party services such as the App Store and server
providers, and problems with your device.
Recordings are stored on your device inside the App. Save important
recordings to the Photos app in case the device is lost or fails or
the App is deleted. The Company is not liable for damages caused by
your own fault.
Where damage results from the Company's willful misconduct or
gross negligence, the Company is liable in accordance with
applicable law.

10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws
of the Republic of Korea. If a dispute arises between the Company and
a user in connection with the App, both parties will make a
good-faith effort to resolve it amicably. If no resolution is
reached, either party may bring an action before the competent court
under the Civil Procedure Act of the Republic of Korea.
